Legal Notice — Spain
1. Identifying details
- Company name: FORQUANTIQ S.A.S.
- Country of incorporation: Colombia
- Nature of operations in Spain: cross-border provision of services (export of services), with no permanent establishment in Spanish territory
- Contact email: info@forquantiq.com
2. Purpose
This legal notice governs access to and use of the website forquantiq.com/en/, through which FORQUANTIQ presents its cybersecurity, digital transformation and quality services aimed at the Spanish market, provided from Colombia.
3. Classification of the service
Secure Web 360 is classified commercially and for tax purposes as a specialized professional managed cybersecurity service (Managed Cybersecurity), not as a pure SaaS product nor as an automated electronic service. The technology tools used (monitoring, automation, dashboards) are part of the methodology with which FORQUANTIQ provides the service, but they do not in themselves constitute the main object sold to the client — what matters is the actual object contracted and the professional intervention and judgment of FORQUANTIQ in each analysis.
4. Terms of use
Access to this website confers the status of user and implies acceptance of the conditions set out in this legal notice.
5. Intellectual and industrial property
The content, brand, logos and graphic elements of this site are the property of FORQUANTIQ S.A.S. and are protected by the applicable intellectual and industrial property legislation.
6. Applicable law
As this is a service provided from Colombia to clients in Spain, the applicable law may vary depending on the type of client:
- Business clients (B2B): the contractual relationship is governed primarily by what the parties agree; in the absence of an express agreement, the private international law rules applicable to a cross-border provision of services apply. The general B2B place-of-supply rule locates the service in the client's country; for VAT purposes, the transaction is invoiced without Spanish VAT and the Spanish client self-assesses the tax through the reverse-charge mechanism (art. 69 of the Spanish VAT Act), a mechanism expressly contemplated by the Spanish Tax Agency (AEAT) for providers not established in Spain.
- Private individuals (B2C): consumer protection rules of the client's country of residence (Spain/EU) may apply, even where the provider is not established in that territory. For VAT purposes, since Secure Web 360 is a professional service with human intervention and technical judgment — and not a "service supplied by electronic means" according to the European Commission's criteria — the special place-of-supply rule for B2C electronic services does not apply and, therefore, neither does the Union scheme of the One-Stop Shop (OSS) by default. The general B2C place-of-supply rule applies, which locates the supply where the provider is established: as FORQUANTIQ is established in Colombia, with no permanent establishment in Spain, the supply is not located in Spain merely because the client resides there, unless a specific exception applicable to the particular case arises.
This classification must remain consistent across contracts, commercial proposals, invoicing and the description of the service, and is subject to confirmation by a Colombia–Spain tax advisor before operating at scale in the B2C segment.
7. Effective date
This legal notice is effective from 10 October 2026 and remains in force until replaced by a later version. Any modification will be published on the FORQUANTIQ website.
